Board Meeting                                   February 14, 2022                              7pm

Minutes

Attendance: Chairman Neale Jones, Supervisor Peter McFarland, Supervisor Ron Johnson, Clerk-Treasurer Susan Johnson, Assessor P. Joseph Plasil, Randy Soldner, Mike Henneberry, Steven Yohn, Cindy & Bruce Williams, Todd & Kandice Blank, Chris Leischer, Steve Kaufeld Jay Blasé, Shannon O’Gorman.

 1. The Board meeting was called to order at 7:01pm by Chairman Neale Jones, the Pledge of Allegiance was recited.

2. The Minutes were reviewed by the Town Board, on a motion by Supervisor Johnson to accept the minutes as read, seconded by Supervisor McFarland. Motion Carried.

3. The Treasurers Report was read by the Clerk-Treasurer Johnson, on a motion by Supervisor McFarland to accept the report as read and seconded by Supervisor Johnson. Motion Carried.

4. The monthly bills were read by Clerk-Treasurer Johnson; Supervisor Johnson made a motion to pay monthly bills and Supervisor McFarland seconded. Motion Carried.

5. Correspondence-None to report.

6. Reports.

a. Waterloo Fire report for December 2021. There were no calls to the Town of Shields.  In 2021,  totals for the year are City of Waterloo, Township of Portland, mutual aid for Lake Mills, Watertown, Ixonia, Marshall was: EMS-386, Fire-55, Hazardous Conditions-19, False Alarms-28, Motor Vehicle Crash-9, Service Calls-41, Rescue Calls-0, Weather Related Calls-1. Total runs for Waterloo Fire Department 539.

b. Watertown Rural Fire Department report was not ready at meeting time. The decision of the Tender was to check into more pricing. Prices are unlikely to decrease, moving forward placing an order for a new pumper tender is probably likely to happen.

c. Dodge County Unit Meeting and Dodge County Broadband Assessment Study meeting, were attended by Chairman Jones. Both covered the Broadband Assessment Study. DCLR & PD members were in attendance to gather, information, questions and answers and how long will this take to implement. There is a study being put together to answer all these questions. It will take a long time for the infrastructure to be put in place and will be the most expensive part. More information will be coming.

d. A stop sign will be fixed @Barry and Long Roads, and an upside down signed on Walton @Long Road. Noted by board.

7. Old Business.

a. ATV/UTV Ordinance was read aloud by Supervisor Johnson. Chairman Jones asked for any question to be addressed. There were none. Supervisor Johnson maid a motion to accept Ordinance 2022-03 All-Terrain Vehicles (ATV) and Utility-Terrain Vehicle (UTV) Routes on all Highway roads in the Town of Shields, and Supervisor McFarland seconded. Motion Carried, all were in favor. No one opposed, No one abstained. Clerk will post and publish ordinance and mail copies.

10. Public Comment-

a. Steve Kauffeld stood and asked for support in the upcoming April 5th Spring Election. He is running for Dodge County Supervisor District 20, serving Town of Shields, Portland, Elba & Lowell. His bullet points are; Protect our Bill of Rights and Constitution, Pro Law Enforcement, Advocate for Smaller More Efficient County Government, Pro Traditional Family Values, Christian Principles, Support our Farming Communities, Protect our Small Businesses, Will Oppose unjust/Illegal Edicts, Opinions, Mandates. b. Chris Leischer asked if there was any new news on what is happening with HWY Q. There has been articles in the paper about DC roads due for repair. At meeting time no definite decision has been made.

Supervisor Johnson called for the meeting to be adjourned at 7:39pm and Supervisor McFarland seconded. Motion Carried Meeting Adjourned.

Ordinane 2022-03

ALL-TERRAIN VEHICLE AND UTILITY-TERRAIN VEHICLE ROUTES ON ALL HIGHWAY ROADS IN THE TOWN OF SHIELDS

STATE OF WISCONSIN Section 28.18 of the Town Code is created as follows:

Town of Shields, Dodge County

SECTION 1 PURPOSE– The Purpose of this ordinance is to establish All-Terrain Vehicle (ATV) and Utility Terrain Vehicle (UTV) routes in the Town of Shields, Dodge County, Wisconsin.

SECTION 2 AUTHORITY – The Town of Shields, Dodge County, Wisconsin has the specific authority to adopt this ATV/UTV Route Ordinance under s. 23.33(8)(b) and (11), Wisconsin statues. Any future amendments, revisions or modifications of the statues incorporated herein are made part of this ordinance to secure uniform statewide regulation of ATVs and UTVs.

SECTION 3 OPERATION OF ATV/UTVs- Pursuant to s. 23.33(4)(d)4., Wis. Stats., except as otherwise provided in s. 23.33(4), Wis. Stats., no person may operate an ATV/UTV on the roadway portion of any highway in the town except on the roadways that are designated routes by this ordinance. Operation of ATV/UTV on a roadway in the town that is an ATV/UTV route is authorized for the extreme right of the roadway, except for left turns that may be made from any part of the roadway that is safe given prevailing conditions. ATV/UTVs shall not operate in the ditch, or other parts of the highway right-of-way and yield the right-of-way to other vehicles, pedestrians, animals using the roadway or shoulder.

SECTION 4 DESIGNATION OF ATV/UTV ROUTES

  1. Adoption of State ATV/UTV Laws and Definitions: State ATV and UTV law and definitions found in Wisconsin State Statues 23.33 and Wisconsin Administrative Code NR64 are adopted by reference and fully incorporated herein by reference, pursuant to Wisconsin State Statues 23.33(11)(a).
  2. Routes:  Any town road that is signed in accordance with NR 64.12 and NR 64.12(7)c (as those sections may hereafter be amended) may be used by the ATV/UTVs in accordance with such signage as provided by the applicable portions of 23.33 Wis. Stat and this ordinance.
  3. Designation:  Under Wis. Stat. s. 23.33(8)(b)1, the town of Shields designates all town roads as an ATV/UTV route.

SECTION 5 CONDITIONS APPLICABLE TO ATV/UTV ROUTES

  1. Routes shall be marked with uniform ATV/UTV route signs in accordance with s.NR 64.12(7), Wis Administrative Code. No person may do any of the following regarding signs marking town ATV/UTV routes:

Intentionally remove, damage, deface move, or obstruct any uniform ATV/UTV route or trail sign or standard, or intentionally interfere with the effective operation of any uniform ATV/UTV route or trail sign or standards if the sign or standard is legally placed by the state, by this municipality, Quad County Runners ATV/UTV Club or any authorized individual.
  3. In accordance with 23.33(9), ATV/UTV signs will be posted at all entrances to the township. Under Wisconsin Act 87, authorized routes with a posted speed limit in this municipality of 35 mph or less are included as ATV/UTV routes under this ordinance. No ATV/UTV shall be allowed to operate in the Town of Shields, Dodge County roadways between the hours of 10pm and 6am.
  4. Route signs in the Town of Shields shall be provided by and shall be marked by the Quad County Runners ATV/UTV Club or their successor with uniform all-terrain vehicle route signs in accordance with Wisconsin Administrative Code §NR6.12(7). Signage shall be inspected annually and shall be maintained by the Quad County Runners ATV/UTV Club or their successor. The Town shall be notified immediately of any change in responsibility for maintenance of ATV/UTV Route signs.

ADDITIONAL RESTRICTIONS AND APPLICABLE TIME PERIODS.

  1. All ATV/UTV Operators must be 16 years of age or older and wear seatbelts.
  2. A valid WI Department of Transportation driver’s license is required to operate any ATV/UTV on a designated route within the township.
  3. All ATV/UTV vehicles must be operated in single file.
  4. No ATV/UTV operator shall exceed the posted speed limit of the road being traveled.
  5. All ATV/UTV riders under the age of 18 must wear a helmet.
  6. All ATV/UTVs must be operated on (paved or graveled) road surfaces only.
  7. All ATV/UTV routes may be closed at any time at the discretion of the Town of Shields Town Board.
  8. ATV/UTV operators are required to have applicable liability insurance.
  9. All ATV/UTVs shall have working headlights, taillights, and brake lights.
  10. All ATV/UTVs must always have their headlights and taillights on.
  11. ATV/UTVs many NOT be operated on any Town of Shields roads between the hours of 10pm and 6am.
  12. All ATV/UTV operations are subject to Wisconsin Department of Natural Resources ATV/UTV Laws and Regulations.
  13. All ATV/UTV operators shall slow the vehicle to safe speed when within 100 feet of a pedestrian, bicyclist, or animals.

SECTION 6 ENFORCEMENT This ordinance may be enforced by any law enforcement officer authorized to enforce the laws of the state of Wisconsin.

SECTION 7 PENALTIES The penalties under s. 23.33(13), Wis. Stats., are adopted by reference.

SECTION 8 SEVERABILITY If any provision of this ordinance or its application to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of this ordinance that can be given effect without the invalid provisions or application, and to this end the provisions of this ordinance are servable.

SECTION 9 MISCELLANEOUS The Clerk is directed to send a copy of this ordinance to the Department of Natural Resources and the Dodge County Sherriff’s Department.

SECTION 10 EFFECTIVE DATE This ordinance is effective upon publication or posting. The Town Clerk shall properly publish this ordinance as required und s.60.80, Wis. Stats.

 1. The Board meeting was called to order at 6:59pm by Chairman Neale Jones, the Pledge of Allegiance was recited.

2. The Minutes were reviewed by the Town Board, on a motion by Supervisor McFarland to accept the minutes as read, seconded by Chairman Jones. Motion Carried.

3. The Treasurers Report was read by the Clerk-Treasurer Johnson, on a motion by Chairman Jones to accept the report as read and seconded by Supervisor McFarland. Motion Carried.

4. The monthly bills were read by Clerk-Treasurer Johnson; Supervisor McFarland made a motion to pay monthly bills and Chairman Jones seconded. Motion Carried.

5. Correspondence.

a. The 2022 District Meeting dates have changed. Clerk Johnson read the new dates and suggested the Board attend Monday, March 28, 2022, Virtual BOR Certification from 8:30am-12pm at the clerk’s home. Chairman Jones, Supervisor McFarland will attend.

b. All Board members are invited to an informational meeting to listen in on (DCB) Dodge County Broadband Assessment Study, on January 24, 2022 at 2pm or 6pm. Noted by the board.

c. Dodge County Unit Meeting will be held on January 19, 2022 at 7:30pm. All board members are invited to attend. Noted by the board.

6. Reports.

a. Watertown Rural Fire Reports; November-no runs to the township, December-one EMS run. The total runs to Shields for 2021 were 4-Fire runs, 13-EMS runs, 0- MVA, 0-HAZCON. Total runs to the township were 19 for 2021.  Waterloo Fire Reports were not ready at meeting time. Chairman Jones also reported on the purchase of a new Tanker/Tender five companies were asked to supply bids, only one sent in a bid. The purchase has been put on hold until further notice.

7. Old Business-

a. The ATV/UTV Ordinance was discussed, the clerk is still collecting the survey slips that were sent out with the tax bills. The discussion was laid over until February 14th board meeting. The deadline for returning the survey’s is February 11, 2022. Noted by the board.
