Minutes

Attendance: Chairman Neale Jones, Supervisor Peter McFarland, Supervisor Ron Johnson, Treasurer Sue Nampel, Clerk Susan Johnson, Steve Yohn, Clint Stiemke, Cody Stiemke.

 1. The Board meeting was called to order at 7:01pm by Chairman Neale Jones, the Pledge of Allegiance was recited.

2. The Minutes were reviewed by the Town Board, on a motion by Supervisor Johnson to accept the minutes as read, seconded by Supervisor McFarland. Motion Carried.

3. The Treasurers Report was read by the Town Treasurer, on a motion by Supervisor Johnson to accept the report as read, and seconded by Supervisor McFarland. Motion Carried.

4. The monthly bills were read by Clerk Johnson; Supervisor McFarland made a motion to pay monthly bills and Supervisor Johnson seconded. Motion Carried.

5. Correspondences;

a. DCLR & PD sent notice of an Approved Land Use Permit for Clint C Stiemke for a 49’ by 60’ new shed. Owner has filled out the proper paperwork thru the county. Noted by the board. Discussion took place on the placement and the parking for a semi. Mr. Stiemke also stated he would like to extend the culvert to 36’. Mr. Yohn requested a fence to be put up as to keep his dog from going over there and he might pasture sheep in the future. Noted by the board.

6. Reports;

a. The Watertown Rural Fire Department had the February 2019 report for the TOS, listed 1 EMS call. Waterloo Fire Reports were not ready at meeting time.

8. New Business;

a. The clerk presented the 2019-2020 Liquor License Applications from Casey’s Saloon and Izaak Walton League of Watertown 2019-2020. Supervisor Ron Johnson made a motion to accept the applications for Casey’s Saloon and Izaak Walton League of Watertown for the July 1, 2019-June 30, 2020, and Chairman Neale Jones seconded. All were in favor. Motion Carried.

2. The Minutes were reviewed by the Town Board, on a motion by Supervisor Johnson to accept the minutes as read, seconded by Supervisor McFarland. Motion Carried.

3. The Treasurers Report was read by the Town Treasurer, on a motion by Supervisor McFarland to accept the report as read, and seconded by Supervisor Johnson. Motion Carried.

4. The monthly bills were read by Chairman Jones, Supervisor McFarland made a motion to pay monthly bills and Supervisor Johnson seconded. Motion Carried.

a. DCLR & PD sent notice of an approved Land Use Permit for Peter and Cindy McFarland for a scale. Noted by the board.

6. Reports;

a. Waterloo Fire Department sent notice of the April 2019 monthly fire report and EMS training. No reports were to the Town of Shields. Watertown reports were not ready at meeting time.

b. Supervisor Peter McFarland attend the April 17, 2019 Town Officers, WTA Dodge County Unit meeting in Juneau. Speakers John Bohonek, DC Land Conservation discussed land nutrient, plus services offered. Mark Born discussed the CAT Program. Chairman McFarland said all information presented was good. Next meeting will take place July 17, 2019.

8. New Business;

a. The Watertown Chapter Izaak Walton League 2019 Meat Shoots applied for permits for the following dates; April 28, May 19, June 23, July 21, August 25, September 22, 2019. Town permits have been purchased and sent.

b. DCLR & PDsent notice on the petition of Patricia Jo Bickel, agent for Doris M Friedl Irrevocalbe Trust to rezone approximately 6.6 acres of land from A-1 Prime Agricultural Zoning District to the A-2 General Agricultural Zoning District to allow for the creation of

a non-farm residential lot. The sit is located in part of the NW1/4 of the SE1/4, Section 26 of the Shields, the site address is N621 Walton Road. (Roger & Loyd Quinn).

Clerk Johnson reported that the Plan Commission met on April 25, 2019. And Harold Peckham had made a motion to recommend the Rezoning Petition to the Town of Shields Board for the May 13, 2019 monthly Board Meeting and Sandee Macht seconded. All were in favor. Sandee Macht had made a motion to recommend the Minor Land Division to the Town of Shields Board for May 13, 2019 monthly Board Meeting and Peter McFarland seconded. Motion carried all were in favor. After a short question and answer session, Supervisor Johnson made a motion to accept the Rezoning Petition for Patricia Bickel and Supervisor McFarland seconded. Motion carried; all were in favor. Supervisor McFarland made a second motion to accept the Minor Land Division for Patricia Bickel and Supervisor Johnson seconded. Motion carried all were in favor. Clerk Johnson will fax the signed recommendation to DCLR & PD on 5-14-19.

b. Scott Construction was the only Road Bid the TOS received this year. After looking over the proposal. Supervisor Johnson made a motion to accept bid from Scott Construction, Inc. and Single Seal over hard surfaces with chips on Quarry Road (Cty Qto the N Walton Rd to Rich Rd), Quarry Road (Rich Rd to end) and First Street/Link Street (Cty Q to Rich Rd). Supervisor McFarland Seconded. Motion Carried all were in favor.

10. Public Comment-

a. Kathy Kassube reported that the culvert on the E side of Walton Rd between her home and Brock Phillips home the culvert is almost covered with rocks blocking the water flowage. Chairman and Supervisors will take a look and decide what to do.

 1. The Board meeting was called to order at 7:00pm by Chairman Neale Jones, the Pledge of Allegiance was recited.

2. The Minutes were reviewed by the Town Board, on a motion by Chairman Jones to accept the minutes as read, seconded by Supervisor McFarland. Motion Carried.

3. The Treasurers Report was read by the Town Treasurer, on a motion by Chairman Jones to except the report as read, and seconded by Supervisor McFarland. Motion Carried.

a. The US Department of Agriculture, Rural Development sent notice of Available Funding Programs for Individuals and Communities. Noted by the board.

b. The TOS Board accepted the application for Charles & Tony Schadt for a new culvert on W8800 Long Road.

c. The WTA sent notice of the May 2019 Workshops in our area. Noted by the board,

d. Waste Management sent a reminder for residents to “Don’t Bag your Recyclables-place clean, rinsed out items Directly in recycling container”.

e. DCLR &PD sent notice of an approved Land Use Permit for Brad Steffen on W8890 Middle Road for a Detached Garage.

f. There will be a Dodge County Unit of WTA meeting on Wednesday, April 17, 2019 at 7:30pm. All board members are invited to attend. Noted by the board

g. The City of Watertown will hold a Public Hearing on April 16, 2019 at the Council Chambers of the Municipal Building, Watertown on the Amendment to the Comprehensive Plan. If you would like to view the proposed amendment go to;

h. The TOS Board accepted the application for Sandra Sykes for a new driveway at N349 Barry Road.

6. Reports;

a. The Waterloo Fire & Rescue sent their February 2019 Activity Report, No reports to the Town of Shields. The Watertown Rural Fire Department reported; 4-EMS calls for the month of March. Noted by the board.

7. Old Business;

a. Discussion of Elections workers pay was discussed many months ago from raising the pay from $7.50 and hour to the current minimum wage in WI. Supervisor Johnson made a motion to raise the Election workers pay to $8.60 and hour and Supervisor McFarland seconded. Motion Carried all were in favor.  

8. New Business;

a. The clerk is in the process of putting together an Emergency Response Plan for the Township with the help of Amy Nehls from Dodge County Emergency Management.

b. The Town is looking into a possible different bank to earn more interest.

c. The Town of Shields will hold Open Book on April 24, 2019 from 5-7pm at the Emmet Town Hall. And will hold Board of Review on May 13, 2019 from 5-7pm at the Emmet Town Hall. To set up an appointment for Open Book please call the clerk at 920-261-7154.

d. Chairman Jones and Supervisors’ Johnson and McFarland will conduct the Annual Road Review on April 26, 2019 at 9am.

e. Discussion on combining the Clerk and Treasurer position was discussed by the board. The clerk will begin looking at this procedure and cost. This would not happen until the next Election in 2021.

9. Miscellaneous;

a. The 2019 Annual Meeting will be held on April 23, 2019 at 7pm at the Emmet Town Hall.

b. The Town of Shields 13th Annual Roadside Clean Up will be held April 27, 2019. Weather cooperating. You can sign up for roads to clean up and pick up bags from Father Anthony Good at the Transfer site. Cookies and water bottles will be available from 9-11 for residents. Keep the Town of Shields Clean!!

The Town of Shields is seeking bids for road maintenance in 2019 as follows:

Asphalt Wedging parts of certain roads. Submit a price per ton applied and include a description of material and quantities to be used.  

Seal Coating certain roads and Slurry Seal. Submit price per mile on a 20 foot wide surface. Include a description of materials and quantities to be applied.

NOTICE IS HEREBY GIVEN that Open Book of the 2019 Assessment Roll for the Town of Shields will be available for review. On Monday, April 24, 2019 at the Emmet Town Hall, W6777 Second Street, Watertown, WI. From 5pm-7pm.  This is the time for any property owners having questions about their assessments to meet with the assessor; P. Joseph Plasil for the Town of Shields. BOARD OF REVIEW

Notice is hereby given that the Board of Review for the Town of Shields, Dodge County, Wisconsin, shall hold its first meeting on Monday, May 13, 2019 from 5-7 pm, at the Emmet Town Hall. Please be advised of the following requirements to appear before the board of review and procedural requirements if appearing before the board:

1.   No person will be allowed to appear before the board of review, to testify to the board by telephone, or to contest the amount of any assessment of real or personal property if the person has refused a reasonable written request by certified mail of the assessor to view the property.

2.   After the first meeting of the board of review and before the board’s final adjournment, no person who is scheduled to appear before the board of review may contact or provide information to a member of the board about the person’s objection, except at a session of the board.

3.   The board of review may not hear an objection to the amount or valuation of property unless, at least 48 hours before the board’s first scheduled meeting, the objector provides to the board’s clerk written or oral notice of an intent to file an objection, except that upon a showing of good cause and the submission of a written objection, the board shall waive that requirement during the first 2 hours of the board’s first scheduled meeting, and the board may waive that requirement up to the end of the 5th day of the session or up to the end of the final day of the session if the session is less than 5 days with proof of extraordinary circumstances for failure to meet the 48-hour notice requirement and failure to appear before the board of review during the first 2 hours of the first scheduled meeting.

4.   Objections to the amount or valuation of property shall first be made in writing and filed with the clerk of the board of review within the first 2 hours of the board’s first scheduled meeting, except that, upon evidence of extraordinary circumstances, the board may waive that requirement up to the end of the 5th day of the session or up to the end of the final day of the session if the session is less than 5 days. The board may require objections to the amount or valuation of property to be submitted on forms approved by the Department of Revenue, and the board shall require that any forms include stated valuations of the property in question. Persons who own land and improvements to that land may object to the aggregate valuation of that land and improvements to that land, but no person who owns land and improvements to that land may object only to the valuation of that land or only to the valuation of improvements to that land. No person may be allowed in any action or proceedings to question the amount or valuation of property unless the written objection has been filed and that person in good faith presented evidence to the board in support of the objections and made full disclosure before the board, under oath, of all of that person’s property liable to assessment in the district and the value of that property. The requirement that objections be in writing may be waived by express action of the board.

5.   When appearing before the board of review, the objecting person shall specify in writing the person’s estimate of the value of the land and of the improvements that are the subject of the person’s objection and specify the information that the person used to arrive at that estimate.

6.   No person may appear before the board of review, testify to the board by telephone, or object to a valuation if that valuation was made by the assessor or the objector using the income method of valuation, unless the person supplies the assessor with all the information about income and expenses, as specified in the assessor’s manual under s. 73.03 (2a), Wis. stats., that the assessor requests. The Town of Shields has an ordinance for the confidentiality of information about income and expenses that is provided to the assessor under this paragraph that provides exceptions for persons using information in the discharge of duties imposed by law or the duties of their officer or by order of a court.* The information that is provided under this paragraph, unless a court determined that it is inaccurate, is not subject to the right of inspection and copying under s. 19.35 (1), Wis. stats.

7.   The board shall hear upon oath, by telephone, all ill or disabled persons who present to the board a letter from a physician, surgeon, or osteopath that confirms their illness or disability. No other persons may testify by telephone unless the Board, in its discretion, has determined to grant a property owner’s or their representative’s request to testify under oath by telephone or written statement.   

8.   No person may appear before the board of review, testify to the board by telephone, or contest the amount of any assessment unless, at least 48 hours before the first meeting of the board, or at least 48 hours before the objection is heard if the objection is allowed under s.70.47 (3) (a), Wis. stats., that person provides to the clerk of the board of review notice as to whether the person will ask for the removal of a member of the board of review and, if so, which member, and provides a reasonable estimate of the length of time the hearing will take.
