The September 23, 2021, Planning Commission meeting was called to order by Chairman Tony Peirick at 7:00 pm at the Emmet Town Hall. The Pledge of Allegiance was recited.

  1. The August 26, 2021 Minutes were read by Plan Commission alternate Ron Johnson. Shannon O’Gorman made a motion to accept the minutes as read and Rachel Schroeder seconded. Motion carried all were in favor.
  • Dodge County Land Resources and Parks Department (DCLR & PD) sent notice for a Minor Land Division Letter of Intent Form for Allen and Shirley Sell. Mr. & Mrs. Sell would like to split off one (1) acre of A-1 prime agriculture land on a 35-acre parcel. The intent to sell the property to Dale and Dawn Bratz.  
  • DCLR & PD sent notice of a Conditional Use Permit Application for a 1-acre nonfarm single family residential lot within the A-1 Prime Agricultural Zoning District. Allen & Shirley Sell would like to sell of 1-Acre of Ag Land from an Active Working Farm Operation into a Single-Family Residence. Dale Bratz explained what he is intending to do with the split of one acre is to build a single family residents.
  1. Lee Buescher read a note from Fran Milburn, which states protection of the farmland in the TO-Shields is a priority to her. Lee than read his statement.
    1. Nick Ignarski spoke of behalf of his family and quoted from the TO-Shields Comprehensive Plan about protection farmland also stated the lot the Sell’s are selling is so close to other homes in the area. Could they rethink the location?
    1. Ken and Pam Erdman supported what the Lee, Fran and the Ignargski family presented. Kelsey Erdman who was not present also sent an email to be read at the meeting.
    1. Stephanie Bratz was in support of Dale and Dawn Bratz.
    1. Ron Johnson recited that the request is compliant to Dodge County Land Use codes and the correct paperwork has been filed according to Dodge County’s Permitting process, so the board can only recommend moving forward with the process. Ron then asked why this lot and why 1-acre? Also with everything you have heard here tonight are you willing to re-think your decision on this site. Dale Bratz answered no.

Shannon O’Gorman made a motion to recommend the approval of DCLR & PD Letter of Intent Notification for a Minor Land Division and DCLR & PD Conditional Use Permit Applications, and Rachel Schroeder seconded. Motion Carried. All were in favor.

  •  DCLR & PD sent notice of a Minor Land Division Letter of Intent for Brian Kassube, to divide off 2.5 acres of land with home and buildings on and to leave the rest of the 40 acres as farmland.

  1. Brian Kassube explained what he was intending on doing with the property. A letter was also provided by Lois Schmidt in support of Brian Kassube petitions. After a few short

questions Shannon O’Gorman made a motion to recommend DCLR & PD Minor Land Division Letter of Intent and DCLR & PD Rezoning Petition for Brian Kassube and Ron Johnson seconded. Motion Carried. All were in favor.

Shannon O’Gorman made a motion to adjourn the Plan Commission Meeting at 8:**pm and Ron Johnson seconded. Meeting Adjourned. All were in favor.

 1. The Board meeting was called to order at 7:00pm by Chairman Neale Jones, the Pledge of Allegiance was recited.

2. The Minutes were reviewed by the Town Board, on a motion by Supervisor McFarland to accept the minutes as read, seconded by Chairman Jones. Motion Carried.

3. The Treasurers Report was read by the Clerk-Treasurer Johnson, on a motion by Chairman Jones to accept the report as read and seconded by Supervisor McFarland. Motion Carried.

4. The monthly bills were read by Clerk-Treasurer Johnson; Supervisor McFarland made a motion to pay monthly bills and Chairman Jones seconded. Motion Carried.

5. Correspondents.

a. The Wisconsin Demographic Service sent the final population for the Town of Shields is the 566 residents up from 10 residents from last year.

b. The Town of Shields Plan Commission will meet on Sept 23, 2021 at 7pm at the Emmet Town Hall.

c.  We received a Thank you letter from Scott Construction for the road work we had done this year in the township along with a survey card to be filled out.

a. The Watertown Rural Fire Report were not available at meeting time.

8. New Business

a.  Dodge County Highway Commission sent the 2021-2022 Maintenance Agreement. Chairman Jones made a motion to accept the 2021-2022 Maintenance Agreement that will cost the township $21,487.50, this covers snowplowing, Supervisor McFarland seconded, motion carried all were in favor.

9. Miscellaneous.

a. The October Monthly Board Meeting Date is changed to October 18, 2021, 7pm at the Emmet Town Hall.

10. Public Comment-

a. Brain Kassube presented his applications for a Rezoning Petition and a Minor Land Division for property located at N755 Walton Road. The board discussed that the Plan Commission would have to meet on this on September 23, 2021. Then it would come to the board at the October 18, 2021 Board Meeting.

b. Clerk Johnson also let the board know that the Township was charged and extra $800 in FEES from Waste Management for the month of August and September! That is more than our monthly bill of $586 per month. This is due to people dumping in CONTANIMENTS (such as plastic bags in to recycling, along with stuff that is not recyclable, PLEASE check the list or ask) and the regular waste dumpsters LIDS NOT BEING CLOSED TIGHT!!! If you are going to dump outside of scheduled times, please make sure you CLOSE THE LID TIGHTLY! BREAK DOWN YOU TRASH SO IT FITS IN THE DUMPSTER. DO NOT LEAVE IT UP TO THE PEOPLE WHO TAKE CARE OF THE SITE ON UNSCHEDULED TIMES!!! The Town Board will be installing cameras, and you will be fined soon if this keeps happening.

  1. The August 26, 2021, Planning Commission meeting was called to order by Chairman Tony Peirick at 7:06pm at the Emmet Town Hall.
  • The July 22, 2021 Minutes were read by clerk Susan Johnson. Rachel Schroeder made a motion to accept the minutes as read and Sandee Macht seconded. Motion carried all were in favor.
  • Dodge County Land Resources and Parks Department (DCLR & PD) sent notice for a Minor Land Division Letter of Intent Form for Allen and Shirley Sell.   • Clerk Johnson presented the Minor Land Division to the board and also noted that before any recommendation can be made the correct paperwork is out of order right now. The Minor Land Division Letter of Intent Form needs to be filed with the Conditional User Permit together. The proper paperwork was not ready at meeting time. The discussion and recommendations were tabled until the paperwork can be filed. The next meeting will take place on September 23, 2021 at 7pm at the Emmet Town Hall.

 1. The Board meeting was called to order at 7:06pm by Chairman Neale Jones, the Pledge of Allegiance was recited.

2. The Minutes were reviewed by the Town Board, on a motion by Supervisor Johnson to accept the minutes as read, seconded by Supervisor McFarland. Motion Carried.

3. The Treasurers Report was read by the Town Treasurer, on a motion by Supervisor McFarland to accept the report as read and seconded by Supervisor Johnson. Motion Carried.

4. The monthly bills were read by Clerk Johnson; Supervisor Johnson made a motion to pay monthly bills and Supervisor McFarland seconded. Motion Carried.

5. Correspondence.

a. The Professional Dairy Producers will hold the “Ace Twilight Meetings, Aug 23 @ Nehls Brothers Farm Ltd in Dodge County. Everyone is welcome to attend. RSVP to 1-800-947-7379 if you would like to attend. Other events are being held in Grant, Marathon and Polk Counties. Noted by the board.

b. Dodge County clean sweep will be held on Saturday, August 28, 2021. For more information and pre-registration visit the Extension Dodge County website at:

www.dodge.extension.wisc.edu . Noted by the board.

c. DCLR & PD sent notice of an approved Land Use Permit for a new barn for the McFarlandale Dairy LLC. Noted by the board.

d. DCLR & PD sent notice of the Public Hearing: Amendment to the Dodge County Year 2030 Comprehensive Plan involving Farmland Preservation Plan Map Dodge County, WI.

6. Reports.

a. The Watertown Rural Fire Report for June was 2-Fire Run to the township. The Waterloo Fire report was not ready at meeting time.

b.  The security camera at the Transfer Site is being worked on by the Chairman and Clerk-Treasurer. We may need to purchase another camera to cover the entire area of the Transfer Site.

c. The 2021 Levy Limit will be available September 1st, the township will be looking at raising the levy this year. Special Elector meeting will be held in the next few months.

I will keep you posted.

d. Chairman Jones has contacted Liberty Tire Recyclers to get rid of the tire pile at the transfer site. If you need to dispose of tires, please see Melody or Dale at the Transfer Site for the prices according to the size of the tire. There also is a NEW FEE Schedule at the Transfer Site. Please note the updates see the posting on the sign board at the site.

e. The Dodge County Unit Meeting was July 21, 2021 attend by Chairman Jones and Clerk-Treasurer Johnson. Speaker Mike Koles, WTA Executive Director talked on the American Rescue Plan Act of 2021 (ARPA) and updated on State Budget. Representative Joan Ballweg also spoke on the State Budget.

8. New Business.

a.  DCLR & PD sent a request for McFarlandale Dairy for a Conditional Use Permit under the Land Use Code, Dodge County to allow the expansion of an animal confinement facility within the A-1 Prim Agricultural Zoning District with a maximum 1589 animal units on this site. The Plan Commission has met on this matter and has made a recommendation to the town board to approve the DCLR & PD request. The board asked Robb & Christine Bender to explain what they plan to do. After discussion Supervisor McFarland chose to abstain from any motion. Chairman Jones then made a motion to accept the DCLR & PD Conditional Use Permit and Supervisor Johnson seconded, motion carried. All were in favor.

b. The town board has opened a savings account for the Town of Shields and has closed out a CD to transfer to the savings account. This will make it easier to transfer funds to checking as needed for monthly meeting. Chairman Jones made a motion to close out CD 3579 and transfer the money to the savings account for the Town of Shields, and Chairman Johnson seconded. Motion Carried. All were in favor.

9. Miscellaneous-None to report.  

10. Public Comment

a. Dale and Dawn Bratz came to the meeting to make sure they had the correct paperwork for a Minor Land Division of 1-acre of property, the owners are Allen and Shirley Sell. The proposed property is located on Walton Road. The Plan Commission will meet on August 26, 2021 at 7pm at the Emmet Town Hall. All are welcome to attend.

11. Next month’s meeting date; February October 11, 2021 at 7 pm at the Emmet Town Hall.

  1. The July 22, 2021, Planning Commission meeting was called to order by Chairman Tony Peirick at 7:02pm at the Emmet Town Hall.
  • The June 24, 2021 Minutes were read by clerk Susan Johnson. Sandee Macht made a motion to accept the minutes as read and Shannon O’Gorman seconded. Motion carried all were in favor.
  • Dodge County Land Resources and Parks Department sent notice of an application of McFarlandale Dairy LLC for a Conditional Use Permit under the Land Use Code, Dodge County, to allow the expansion of an animal confinement facility within the A-1 Prime Agricultural Zoning District with a Maximum 1589 animal units on this site. The property is in part of the NE ¼ of the SE ¼ and part of the SE ¼ of the NE ¼, Section 36, Town of Shields, the site address being N302 County Road K.
  • Chairman Peirick began by asking Robb & Christine to explain the Conditional Use Permit. The plan is to increase approximately 250 units (cows), according to the DC units code. Robb further explained the manure management code and nutrient management plan are
  • to code and are in place. Cris Folk had concerns and asked the McFarland’s to explain the total number of units and discussion took place to clarify the number of units. Cris also asked if they had enough acres to accommodate the manure and smell the extra spreading would have.  Robb explained the manure pit can handle the added manure and the spreading will continue as it has in the past with an average of 14 days per year. The DNR has a plan on how much manure can be put on every acre and they test the soil regularly to make sure they are complying. It is very strict not to over saturate the land. The question of smell was answered “McFarlandale LLC” is not a huge corporation, like the Crave Farms or other larger farmers in the Sun Prairie area who have digesters

to cut down on the smell. As of now McFarlandale does not have digesters to help with the smell, it is a possibility for the future.  After much discussion and a letter to the clerk from residents supporting McFarlandale as good neighbors and tax benefits to the Township. Shannon O’Gorman made a motion to accept the McFarlandale Dairy LLC for a Conditional Use Permit and Sandee Macht seconded. Motion Carried. All were in favor.

  • Shannon O’Gorman made a motion to adjourn the Plan Commission Meeting at 8:19pm and Sandee Macht seconded. Meeting Adjourned. All were in favor.

 1. The Board meeting was called to order at 7:11pm by Chairman Neale Jones, the Pledge of Allegiance was recited.

2. The Minutes were reviewed by the Town Board, on a motion by Supervisor McFarland to accept the minutes as read, seconded by Supervisor Johnson. Motion Carried.

3. The Treasurers Report was read by the Town Treasurer, on a motion by Supervisor McFarland to accept the report as read and seconded by Supervisor Johnson. Motion Carried.

4. The monthly bills were read by Clerk Johnson; Supervisor Johnson made a motion to pay monthly bills and Supervisor McFarland seconded. Motion Carried.

5. Correspondents.

a. Dodge County Unit Meeting will be held on July 21, 2021, at 7pm., at the DC Administration, Neale and Sue will attend.

b. DCLR & PD sent notice of an application of McFarlandale Dairy LLC for a Conditional Use Permit under the Land Use Code, Dodge County, Wisconsin to allow the expansion of an animal confinement facility within the A-1 Prime Agricultural Zoning District with a maximum 1589 animal units on this site, the plan allows for 250 more animals. This will go to the Plan Commission for discussion on July 22, 2021, 7pm at the Emmet Town Hall. And then the board will meet to make a recommendation to the Dodge County, by August 16, 2021.

6. Reports.

a. The Watertown Rural Fire & Waterloo Fire Reports were not ready at meeting time.

b. The State of Wisconsin Department of Revenue has sent ARPA Local Fiscal Recovery Funds notice from the American Rescue Plan Act – Local Fiscal Recovery Funds has allocated to the Town of Shields by the U.S. Department of Treasury in the amount of $58,195.72. These funds are to help with added expenses caused from Covid-19 in 2020-2021. The board is looking into how the money can be spent wisely.

c. Scott Construction has finished seal coating Walton Road to Provimi Road and Barry Road To Middle Road with brown ash, Ranch Road was chip sealed with white stone and Long and Walton Road from last year were redone at not charge in the brown ash seal coating.

8. New Business.

a.  DCLR & PD sent notice for a Minor Land Division for Marlys Schmidt. The Plan Commission has met and made a recommendation to approve the Minor Land Division. After the board discussed the division, Supervisor McFarland made a motion to approve the Minor Land Division and Supervisor Johnson seconded. Motion Carried all were in favor.

b. DCLR & PD sent notice for a Conditional Use Permit for Marlys Schmidt. The Plan Commission has met and made a recommendation to approve the Conditional Use Permit for Marlys Schmidt. After a brief discussion of the Conditional Use Permit, Supervisor Johnson made a motion to accept the Conditional Use Permit and Supervisor McFarland seconded. Motion Carried all were in favor.

c. The Railroad inspector has discovered that Walton Road Crossing will need to have the crossing sign painted on the road at this spot since the speed limit is more than 35 MPH.

Chairman Jones has been working with the Jefferson County Highway Department and the cost will be $442. Supervisor Johnson made a motion to accept this agreement and Supervisor McFarland seconded. Motion Carried all were in favor.

9. Miscellaneous.

a. A reminder that the Election tomorrow is for the Representative to the Assembly District 37 Special Election. Polls open at 7am and close at 8pm.

10. Public Comment

a. Steve Yohn was in attendance and had questions about the “Wild Parsnips” that is growing int some of the ditches. He was wondering what can be done about it, mowing more often, county spraying? He said the county used to spray. Chairman Jones will investigate it.
