Minutes

Attendance: Chairman Neale Jones, Supervisor Peter McFarland, Supervisor Ron Johnson, Treasurer Sue Nampel, Clerk Susan Johnson, Assessor P. Joseph Plasil.

 1. The Board meeting was called to order at 7:00pm by Chairman Neale Jones, the Pledge of Allegiance was recited.

2. The Minutes were reviewed by the Town Board, on a motion by Supervisor McFarland to accept the minutes as read, seconded by Chairman Jones. Motion Carried.

3. The Treasurers Report was read by the Town Treasurer, on a motion by Chairman Jones to accept the report as read and seconded by Supervisor McFarland. Motion Carried.

4. The monthly bills were read by Clerk Johnson; Supervisor Johnson made a motion to pay monthly bills and Supervisor McFarland seconded. Motion Carried.

5. Correspondences.

a.     DCLR & PD sent an approved Land Use Permit for Ed Wolff for a sixteen by forty- foot pool. Noted by the board.

b. DCLR & PD sent an approved Land Use Permit for Jay Blasé for a new seventy-two by forty-two-foot detached garage. Noted by the board.

c. DCLR & PD sent a Notice of Action/Filing of Decision. The Town Board has put together a letter for Thomas Behling that will be on file with the Dodge County Register of Deeds Office. The letter notes the specifics of the road that will need to be put in by the seller at the time of any sale of the property with the current Zoning Limitations at that time.

d. Rural Mutual Insurance Co. sent notice of a reauthorization of the Terrorism Risk Insurance Act of 2019. This act was signed into law on December 20, 2019 and extends the federal Terrorism Risk Insurance Program until December 31, 2027. Noted by the board.

6. Reports.

a. No Fire reports were available at meeting time.

8. New Business.

a.   County Emergency Management sent notice of a resolution they are recommending for adoption. It is the Mitigation Plan. The update serves as a roadmap that outlines

potential cost-effective hazard mitigation activities for future grant funding. The plan highlights the rusks and vulnerabilities that DC faces from natural disasters and

highlights mitigation strategies, that may reduce future losses. Supervisor Johnson made a motion to accept the 2020-03 Resolution of the Dodge County Emergency Management Mitigation Plan and Supervisor Peter McFarland seconded. Motion carried. All were in favor.

b. DCLR & PD sent notice for a Minor Land Division-Letter of Intent Form for John and Irene Miller. The current property is thirty-one-acres, the Millers are requesting to split of one and a half acres for the house and shed, leaving the remaining twenty-nine- and one-half acres as active working farmland. The Plan Commission met on December 10, 2020 at the Emmet Town hall and after a short discussion decided to recommend to the Town Board the Minor Land Division. Supervisor Peter McFarland made a motion to accept the Letter of Intent Notification from DCLR & PD activity number 2020-1195 and Supervisor Johnson seconded. Motion Carried. All were in favor.

c. The 2021 Caucus for the Town of Shields will be held on January 18, 2021 at 7pm at the Emmet Town Hall.

d.  The Town of Shields has been noticing an increase in dumping at the Transfer Site by non-residents. To detour this issue the Town Board has decided to put in electricity at the site, this way we will be able to install motion lights, a web camera and heat to the building for the site works. On a motion by Supervisor Johnson to move forward with this above plan, the process will be beginning as soon as possible and seconded by Supervisor Peter McFarland. Motion Carried. All were in favor.

9. Miscellaneous.

a. Wishing every on a very Merry Christmas and a Happy New Year!

a. The Watertown Rural Fire Department and the Waterloo Fire Department reports were not ready at meeting time.

7. Old Business.

a. ATV/UTV Ordinance discussion was carried out listening to both sides. A survey will be taken when your tax bill is mailed out. Questions about where the signs will be placed and who will maintain, noise was a large topic, hours ATV/UTV should be allowed on the roads. Comparison to Jefferson County rules. If or When TO-Shields passes an ordinance, Dodge County will then choose which County roads will be open for travel in our township. No action will be taken until January or February Board meeting.

b. DCLR & PD Conditional Use Permit and a Minor Land Division Letter of Intent Form for Harold Peckham. Chairman Jones made a motion to allow for the Conditional Use Permit for Harold Peckham and Supervisor Ron Johnson seconded. Motion Carried. All were in favor. Supervisor Ron Johnson made a motion to accept the Minor Land Division for Harold Peckham and Supervisor Peter McFarland seconded. Motion Carried all were in favor.

5. Correspondents.

a. Dodge County Unit Meeting will be held on October 20, 2021 at 7:30pm at the Dodge County Administration Building. Clerk Johnson is going to attend. Noted by the board.

6. Reports.

a. The Watertown Rural Fire Department Report for June was 2-Fire Runs and 1-MVA runs, July was 2-Fire Runs and 2-EMS runs, August was 1-EMS run to the township. The Waterloo Fire Department report was not available at meeting time.

b. The WTA Convention was attended by Supervisor Johnson and Clerk-Treasurer Johnson on October 10-12, 2021 in Wisconsin Dells. There were many listening sessions.

ARPA (American Rescue Plan Act), Elections Commissions, WI Broadband Updates, and many others these were a few we attended.

8. New Business.

a.  Supervisor Johnson read the minutes from the September 23, 2021 Plan Commission Meeting. The recommendation from the Plan Commission was to move forward with the conditional use application.  DCLR & PD sent notice of a Conditional Use Permit Application, for a 1-acre nonfarm single family residential lot within the A-1 Prime Agricultural Zoning District. Allen & Shirley Sell would like to sell off 1-Acre of Ag Land from their Active Working Farm Operation into a

Single-Family Residence, for Dale and Dawn Bratz. After a short discussion, Supervisor Johnson made a motion accept the Conditional Use Permit Application for Allen & Shirley Sell, even though the neighbors have some opposition to the location, and Supervisor McFarland seconded. Motion Carried all were in favor.

b. DCLR & PD sent notice of a Letter of Intent Notification for a Minor Land Division. Allen & Shirley Sell would like to sell off 1-Acre of Ag Land, from an Active Working Farm Operation into a Single-Family Residence. Supervisor McFarland made a motion accept the application for a Minor Land Division Letter of Intent for Allen & Shirley Sell, even though the neighbors have some opposition to the location, and Supervisor Johnson seconded. Motion Carried all were in favor.

c. DCLR & PD sent notice of a Minor Land Division Letter of Intent for Brian Kassube, to divide off 2.5 acres of land with home and buildings on, and to leave the rest of the 37.5 acres as farmland. After a short discussion, Supervisor Johnson made a motion to accept the Minor Land Division Letter of Intent application and Supervisor McFarland seconded. Motion Carried all were in favor.

d. DCLR & PD sent notice of a Rezoning Petition for Brian Kassube, to divide 2.5 acres of land with the home and buildings. After a short discussion Supervisor Johnson made a motion to accept the Minor Land Division Letter of Intent application and Supervisor McFarland seconded. Motion Carried all were in favor.

e. Dodge County Humane Society sent the Stray Animal Contract for 2022, the option the board chose was “A lump sum of $1300 which covers up to 5 domestic stray animals. Animals more than 5 will be charged $300 per animal.

This is up $200 from last year’s contract. Supervisor McFarland made a motion to accept the 2022 Dodge County Humane Society Contract, and Supervisor Johnson seconded. Motion Carried all were in favor.

f. Dodge County Sheriff’s Office sent the yearly 911 Joint Powers Agreement for 2022. Supervisor Johnson made a motion to accept the contract as written, and Supervisor McFarland seconded. Motion Carried all were in favor.

10. Public Comment-

a. ATV/UTV discussion started by Chairman Jones, people in the township have been contacting him about bringing the ATV/UTV back up for discussion. Kandice Blank has brought a petition tonight she has collected about seventy signatures in favor of having

the all-terrain vehicles run on the town of shields roads.  Kandice also contacted Randy Soldner from the “Quad County Runners ATV/UTV Club” to be present tonight to answer as many questions as possible. The Town Board is going to look over past and present information and will have another discussion at the November 8, 2021 monthly board meeting at the Emmet Town Hall at 7pm. The Board would like to invite Town of Shields residents to attend this meeting, (not non-resident club members) to hear your thoughts on ATV/UTV in the town of Shields. You can also email the clerk your vote and reason why you are voting this way. Please attend if you have questions.

The September 23, 2021, Planning Commission meeting was called to order by Chairman Tony Peirick at 7:00 pm at the Emmet Town Hall. The Pledge of Allegiance was recited.

  1. The August 26, 2021 Minutes were read by Plan Commission alternate Ron Johnson. Shannon O’Gorman made a motion to accept the minutes as read and Rachel Schroeder seconded. Motion carried all were in favor.
  • Dodge County Land Resources and Parks Department (DCLR & PD) sent notice for a Minor Land Division Letter of Intent Form for Allen and Shirley Sell. Mr. & Mrs. Sell would like to split off one (1) acre of A-1 prime agriculture land on a 35-acre parcel. The intent to sell the property to Dale and Dawn Bratz.  
  • DCLR & PD sent notice of a Conditional Use Permit Application for a 1-acre nonfarm single family residential lot within the A-1 Prime Agricultural Zoning District. Allen & Shirley Sell would like to sell of 1-Acre of Ag Land from an Active Working Farm Operation into a Single-Family Residence. Dale Bratz explained what he is intending to do with the split of one acre is to build a single family residents.
  1. Lee Buescher read a note from Fran Milburn, which states protection of the farmland in the TO-Shields is a priority to her. Lee than read his statement.
    1. Nick Ignarski spoke of behalf of his family and quoted from the TO-Shields Comprehensive Plan about protection farmland also stated the lot the Sell’s are selling is so close to other homes in the area. Could they rethink the location?
    1. Ken and Pam Erdman supported what the Lee, Fran and the Ignargski family presented. Kelsey Erdman who was not present also sent an email to be read at the meeting.
    1. Stephanie Bratz was in support of Dale and Dawn Bratz.
    1. Ron Johnson recited that the request is compliant to Dodge County Land Use codes and the correct paperwork has been filed according to Dodge County’s Permitting process, so the board can only recommend moving forward with the process. Ron then asked why this lot and why 1-acre? Also with everything you have heard here tonight are you willing to re-think your decision on this site. Dale Bratz answered no.

Shannon O’Gorman made a motion to recommend the approval of DCLR & PD Letter of Intent Notification for a Minor Land Division and DCLR & PD Conditional Use Permit Applications, and Rachel Schroeder seconded. Motion Carried. All were in favor.

questions Shannon O’Gorman made a motion to recommend DCLR & PD Minor Land Division Letter of Intent and DCLR & PD Rezoning Petition for Brian Kassube and Ron Johnson seconded. Motion Carried. All were in favor.

a. The Wisconsin Demographic Service sent the final population for the Town of Shields is the 566 residents up from 10 residents from last year.

b. The Town of Shields Plan Commission will meet on Sept 23, 2021 at 7pm at the Emmet Town Hall.

c.  We received a Thank you letter from Scott Construction for the road work we had done this year in the township along with a survey card to be filled out.

8. New Business

a.  Dodge County Highway Commission sent the 2021-2022 Maintenance Agreement. Chairman Jones made a motion to accept the 2021-2022 Maintenance Agreement that will cost the township $21,487.50, this covers snowplowing, Supervisor McFarland seconded, motion carried all were in favor.

9. Miscellaneous.

a. The October Monthly Board Meeting Date is changed to October 18, 2021, 7pm at the Emmet Town Hall.

10. Public Comment-

a. Brain Kassube presented his applications for a Rezoning Petition and a Minor Land Division for property located at N755 Walton Road. The board discussed that the Plan Commission would have to meet on this on September 23, 2021. Then it would come to the board at the October 18, 2021 Board Meeting.

b. Clerk Johnson also let the board know that the Township was charged and extra $800 in FEES from Waste Management for the month of August and September! That is more than our monthly bill of $586 per month. This is due to people dumping in CONTANIMENTS (such as plastic bags in to recycling, along with stuff that is not recyclable, PLEASE check the list or ask) and the regular waste dumpsters LIDS NOT BEING CLOSED TIGHT!!! If you are going to dump outside of scheduled times, please make sure you CLOSE THE LID TIGHTLY! BREAK DOWN YOU TRASH SO IT FITS IN THE DUMPSTER. DO NOT LEAVE IT UP TO THE PEOPLE WHO TAKE CARE OF THE SITE ON UNSCHEDULED TIMES!!! The Town Board will be installing cameras, and you will be fined soon if this keeps happening.
